October 2007- Trip and Fall in the Miami Dade County
Parking Garage- $62,500.00 settlement
On February 2, 2006,
Mr. WEBER, while walking through the Miami-Dade County
parking garage was injured his left shoulder, left wrist
and left knee when he tripped and fell over an exposed
pipe protruding from a platform that was in an area
designated for pedestrian traffic. We filed a claim
against the city of Miami-Dade County for failing to
properly maintain its premises in a reasonably safe
condition for use by Plaintiff and others similarly
situated. The evidence in the case revealed that the
Miami-Dade county employees either created the dangerous
condition or knew or should have known of the dangerous
condition and failed to correct same and failed to warn
Mr. Weber of the dangerous condition. Miami Dade County
paid $62,500.00 to resolve this case at mediation prior
to trial.
August 2007- Auto Owner
Insurance Company tenders UM policy limits of $300,000.00
to victims of Drunk Driving accident
Mr. Alderman was driving
under the influence of alcohol, crossed over the median
and struck our client’s vehicle head on. The impact
was severe and Mr. Alderman was pronounced dead at the
scene. Unfortunately, Mr. Alderman only carried bodily
injury coverage in the amount of $10,000.00 per person,
$20,000.00 per occurrence with Nationwide Insurance.
Nationwide tendered their policy limits of $20,000.00.
Thereafter, we filed a claim against the victim’s
Underinsured Motorist coverage to compensate him and
his three passengers for the severe injures they sustained.
Auto Owners Insurance Company tendered the $300,000.00
policy limits to resolve the claim.
January 2007- Policy
Limits tended to a victim of a motor vehicle accident
for the partial amputation of his finger
On June 27, 2006, at
approximately 5:00 p.m. Mr. Michel was a restrained
front seat passenger in a Ford Explorer traveling southbound
on Interstate 95. At said time and place, the vehicle
for some unknown reason went off the road striking several
bushes and ultimately crashing head-on into a tree with
great force. Mr. Michel sustained serious injuries and
damages as a direct result of the accident, including
but not limited to the partial amputation of this left
third finger and the removal and repair of the nail
bed to his left fourth finger. We filed a negligence
claim against the driver’s insurance company and
they tendered their policy limits to Mr. Michel to resolve
the claim.
